Welcome to Impact Tutoring LTD. By using our services, you agree to the following terms and conditions, which constitute a legal agreement between you (the “User”) and Impact Tutoring LTD (“Impact Tutoring,” “we,” “us,” or “our”). 1. Introduction

Impact Tutoring LTD is a UK-based online tutoring platform that connects tutees (“Students”) with tutors (“Tutors”). Our services facilitate the arrangement of tutoring sessions between Students and Tutors. Impact Tutoring does not charge Tutors any fees for using the Platform.

2. Eligibility

By using the Platform, you represent and warrant that:

  • You are at least 18 years old or have obtained parental or guardian consent to use the Platform.
  • You have the legal capacity to enter into this agreement and comply with these terms and conditions.

3. User Accounts

3.1 Registration

To use certain features of the Platform, you must register for an account (“Account”). You agree to:

  • Provide accurate and up-to-date information during registration.
  • Maintain the confidentiality of your Account credentials.
  • Notify us immediately of any unauthorized use of your Account.

3.2 User Responsibilities

You are responsible for all activities that occur under your Account. You agree not to:

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Engage in any activity that interferes with or disrupts the Platform.

4. Tutoring Services

4.1 Tutor Responsibilities

Tutors agree to:

  • Provide tutoring services in a professional and competent manner.
  • Comply with all applicable laws, including but not limited to data protection, child protection, and intellectual property laws.
  • Maintain the confidentiality of all Student information.

4.2 Student Responsibilities

Students agree to:

  • Provide accurate information when booking tutoring sessions.
  • Respect the Tutor’s time and effort by attending scheduled sessions punctually.
  • Comply with all applicable laws while using the Platform.

5. Payments and Fees

5.1 Payment Processing

Impact Tutoring facilitates payments between Students and Tutors. Payments for tutoring sessions are made directly by the Student to the Tutor through the Platform.

5.2 Fees

Impact Tutoring does not charge Tutors any fees for using the Platform. Students may be charged a service fee, which will be clearly communicated before any transaction.

6. Cancellations and Refunds

6.1 Cancellations

Students may cancel or reschedule tutoring sessions according to the cancellation policy established by the Tutor. Tutors are required to clearly communicate their cancellation policies to Students before confirming a session.

6.2 Refunds

Refunds for canceled or unsatisfactory sessions are subject to the Tutor’s refund policy. Impact Tutoring may assist in mediating disputes but is not responsible for issuing refunds.

7. Code of Conduct

All Users agree to:

  • Respect each other’s privacy and confidentiality.
  • Refrain from any form of harassment, abuse, or discriminatory behavior.
  • Use the Platform only for lawful purposes.

8. Intellectual Property

8.1 Ownership

Impact Tutoring and its licensors retain all rights, title, and interest in and to the Platform, including all software, text, images, and other content provided on the Platform.

8.2 User Content

Users retain ownership of any content they submit to the Platform. By submitting content, Users grant Impact Tutoring a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute the content solely for the purpose of operating and improving the Platform.

9. Data Protection and Privacy

9.1 Data Collection

Impact Tutoring collects and processes personal data in accordance with our Privacy Policy, which complies with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

9.2 Data Security

We take reasonable measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. However, no internet-based service is completely secure, and we cannot guarantee absolute security.

10. Liability and Disclaimers

10.1 No Liability for Tutors’ Actions

Impact Tutoring acts solely as a platform to connect Students with Tutors. We do not employ Tutors and are not responsible for the actions, conduct, or services provided by Tutors.

10.2 Disclaimer of Warranties

The Platform is provided “as is” without any warranties of any kind, whether express or implied. We do not guarantee that the Platform will be error-free, secure, or uninterrupted.

10.3 Limitation of Liability

To the maximum extent permitted by law, Impact Tutoring will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of the Platform.

11. Indemnification

You agree to indemnify and hold harmless Impact Tutoring, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the Platform or violation of these terms.

12. Amendments

We reserve the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new terms.

13. Governing Law and Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
